Website terms of use
The terms for using this website, its forms, the project wizard and the AI assistant. The client portal has its own terms, and work we do for clients is governed by a signed Services Agreement, which always prevails.
These terms are a draft prepared before launch; a lawyer will review them before the site goes live.
Effective
About these terms
These terms apply to your use of the website at eloradigital.com.au (the site), which is operated by ELORA DIGITAL Pty Ltd (ELORA DIGITAL, we, us), Box Hill North VIC 3129, Australia. ABN 85 703 334 098. By using the site you agree to them.
Work we do for a client is governed by the written Services Agreement for that project, not by these terms. The client portal is governed by the client portal terms, which you accept when you create an account.
Our privacy policy explains how we handle personal information.
Acceptable use
You may browse the site, link to any page and quote short extracts with attribution. You must not:
- try to gain access to any part of the site, its systems or its data that is not meant for you;
- send spam, scams, abuse or anything unlawful through our forms, the project wizard or the assistant, or submit content on someone else's behalf without their permission;
- upload or transmit malware, or anything designed to disrupt the site;
- scrape, copy or harvest content or contact details at scale, or use the site to train AI models without our written permission;
- misrepresent who you are or your connection to any business;
- try to make the assistant or the project wizard act outside their purpose, reveal their instructions or produce content for you that has nothing to do with a project of yours.
Submissions are screened automatically for spam and abuse, and we may block an email address, domain or IP address that breaks these rules.
General information, not advice
Everything on the site, including articles, prices, timelines, the project wizard's brief and estimate, and the answers of the AI assistant, is general information. It is not legal, financial or tax advice, and it is not a quote. A price or a timeline becomes binding only when it is set out in a written scope that both of us have signed.
The project wizard's estimate is calculated from our published price ranges and labelled indicative; a founder confirms it in writing after a call. The assistant is an AI: it can be wrong, it cannot commit us to anything, and it is instructed never to ask you for a password or payment details. Never give it either.
We take care to keep the site accurate and current, but we do not promise that every page is complete, correct or up to date, and we may change prices and content at any time without notice.
Intellectual property
The text, design, code, images and logos on the site are owned by ELORA DIGITAL Pty Ltd or used under licence, and are protected by copyright and trade mark law. You may view and print pages for your own use. Any other reproduction, distribution or commercial use needs our written permission.
Product names and trade marks mentioned on the site belong to their respective owners. Articles and case studies may be shared with a link to the original page.
What you send us through a form, the wizard or the assistant stays yours. You give us permission to use it to answer you, prepare a quote and run our screening, and for nothing else.
Links to other sites
The site links to other websites and services, such as product sites, documentation and booking tools. We do not control them and are not responsible for their content, their privacy practices or their availability. A link is not an endorsement. Those sites have their own terms, which apply when you use them.
Limitation of liability
The Australian Consumer Law gives you guarantees that cannot be excluded, and nothing in these terms limits them. To the extent the law allows:
- the site and its content are provided as they are, without any other warranty, express or implied;
- we are not liable for any loss or damage, including indirect or consequential loss, lost profit or lost data, that comes from using the site, being unable to use it, or relying on general information on it, including anything the assistant or the wizard says;
- where liability cannot be excluded, it is limited to supplying the relevant service again or paying the cost of having it supplied again.
Governing law
These terms are governed by the law of Victoria, Australia. Any dispute about them is subject to the non-exclusive jurisdiction of the courts of Victoria and the courts that hear appeals from them.
The client portal
The client portal is where clients follow their projects, share files, send messages, review quotes and see invoices. It has its own terms, which cover your account and its security, acceptable use, uploads and scanning, how a quote is accepted and what that records, availability, suspension and deleting your account. You accept them when you create an account, and they apply alongside these terms and the privacy policy: client portal terms.
The Services Agreement prevails
If anything in these terms conflicts with the written Services Agreement you have signed with us, the Services Agreement prevails for that project. These terms do not change the scope, price, timeline, warranty or intellectual property arrangements in that agreement.
Changes to these terms and how to contact us
These terms are effective from 23 October 2026. We may update them from time to time; the new version is published on this page with a new date.
Questions about these terms: contact@eloradigital.com.au. Postal address: we give you one on request.
